Buyer wants to withdraw from the purchase?

Re

I have an urgent question. Some time ago I put a sewing machine up for sale on Ebay Classifieds. On Sunday it was sold and yesterday the seller wrote to me that an embroidery unit was missing. Also two other things (fabrics and fleeces). Both things are correct and I had forgotten and told him that I would send this off immediately. But now he says he wants this unit for embroidery. Which I do not have, which I did not write in the text and which could not be seen in the photos. Now he's threatening me with a lawyer because I don't want to take the products back.
Am i right Or what should I do?

I have attached a few pictures of the sewing machine and here below the text which I had put in (one picture, white background shows the unit that the buyer means)

Buyer wants to withdraw from the purchase Buyer wants to withdraw from the purchase - 1 Buyer wants to withdraw from the purchase - 2

I'm offering a fully functional sewing and embroidery machine from Brother in the Disney Edition.

This machine is no longer available in this version from the dealer.

Due to time constraints, it is not possible for me to use it as it should be used.

The sewing and embroidery machine is covered with a protective cap and has been cared for and kept clean over time. It works perfectly and can also be viewed.

The machine has a fully automatic threading system as well as other extras and is therefore very time-saving.

Also included are various other programs, CD's for transferring to the laptop as shown in the photos. These contain, among other things, different embroidery patterns.

There are also many feet for changing and needles for the machine.

Two pedals are also included.

Madeira thread for embroidery (suitable for Brother Innovis 4000d), embroidery frames and already finished and empty bobbins are also included.

Also cutting scissors, chalk, mats and small cutters.

Everything that is needed for sewing / embroidery.

Yarns:

It includes normal colors at 1000m and 200m. The yarns are easy to process and have a great color intensity.

Neon colors are also available.

Color palettes are available for all colors so that you can reorder them.

If you want more pictures, you can get them on request.

Shipping is also possible

You are NOT right here. The buyer can withdraw from the purchase because you have not pointed out that this embroidery module is not included.

However, he has to make it credible that he has bought the machine in order to also do this module, which can be done relatively easily with any lawyer in the world.

So take the machine back and give him the money back…

Ru

Can the machine be used to sew without the unit? Was the picture with the white background part of the item description?

Ro

Now he's threatening me with a lawyer because I don't want to take the products back.

What a pipe. If the lawyer comes directly for a small part…

Unfortunately, you are still not in the right. You have unconsciously withheld details and the buyer can therefore return the device.

Learn from it. Next time write down which components are available.

Re

No, the picture with the white background was not included.
Since it was an heirloom I don't know exactly but I don't think so

ja

This is actually a bit controversial because you offered the sewing machine as a sewing and embroidery machine and pointed out the possibilities for embroidering with it.

Personally, as an interested party, I would assume that I can then also embroider with the machine. A notice that the embroidery unit is not included would have been appropriate. The pictures alone don't help you if you don't know what the machine looks like without / with an embroidery unit.

The question is, when you buy the machine new, whether the embroidery unit is included in the scope of delivery or whether it can be purchased as an option.

In my opinion, the customer is right to demand withdrawal from the purchase.

I do not dare to evaluate the legal situation here.

Mi

You write that everything for sewing and embroidery is included. But does not explicitly exclude the embroidery module.

What should you do with an embroidery machine that can't embroider?

I'm afraid the buyer is right.

Ru

The small part is decisive for one of the two functions of the device. What should you do with an embroidery machine that you can't embroider with?

Ro

Buy the part again. I have no idea about sewing machines, but the module won't cost the world, it will probably be available very cheaply - the buyer has zero indulgence that the person on the other side can make a mistake.

Of course, it also depends on the questioner, how he wrote and how long the two have been discussing.

Ru

The questioner did not want to send the part. He doesn't even have it. If the questioner sends it, the buyer can't withdraw either.

Ro

Had already corrected my comment.

Ru

I hadn't yet received that.

Ro

Yeah i know sorry.

Op

To make your situation understandable with another example: Let's assume you buy a car. The good driving characteristics of the car are particularly extensively advertised in the sales advertisement. After it has been delivered you find that it has no motor at all.

You then report to the seller and ask about the engine. "What kind of engine?" replies. Of course there's no engine in it. After all, he did not write in the sales advertisement that there was an engine in it and that there was no engine to be seen in the photo in the advertisement. Thus the sales contract for a car without a motor was concluded.

You are now in the same situation that the car seller would find himself in. You have sold a machine and its suitability for knitting was particularly highlighted in the item description. But you can't knit with the machine at all.

If the buyer agrees to reverse the purchase contract, you should happily agree. He could also insist on the subsequent delivery of the knitting module and - if you can't deliver later - get such a module yourself and invoice you for the costs.

Bo

My opinion:

Does the missing part belong to the normal scope of delivery of the machine?

Then you described the machine incorrectly and did not deliver what was contractually agreed.

So you have to deliver or take the part back.

Ri

Did I write?

Mi

I guess you did.

In fact, when you're on your smartphone, it's very easy to slip between the comment columns.

Ri

No problem. Haha was just confused, so I wrote that again as a comment.

Op

Yes, of course, embroider and not knit. Sorry and thanks for the hint.
