I bought a new laptop and it has a problem with the Akuu below.

Then I asked at Mediamarkt and I was told that I should return the laptop and get new (without a problem).
The second laptop has the same problem.

This is not a problem. That's a reference. Just as you get a 50 GB hard drive, but on the end only 48gb are available. That's simply because providers have to stick to benchmarks to make comparisons.
Would be synonymous with hard drives, even if shelves would be full with hard drives of 46 gb or 47 and sometimes 42.
What was the temperature during charging?
Did she comply with the "normal conditions"?
Even with LI-ION you can't use the full rated capacity while maintaining a certain minimum emergency reserve. The values shown indicate a default reserve of approximately 5% of the rated capacity.
Also, note that Li-ION requires about 3 to 5 complete charge / discharge cycles to build up the optimal useful capacity (while maintaining about 5% of emergency reserve).
Thus, I see no problem here actually to manufacturer-related protection against too deep discharge.
