I have received mail that I have committed a shoplifting jointly. But this is by no means the case.
I have a previous conviction for shoplifting, but I learned from it and just wanted to check out gaming laptops. The shoplifting was 6 months ago and the shop detective had also let me into the shop (because of Corona ID checks). I was there with my roommate. I also asked the shop detective whether I could also come in, regarding the house ban, as he had not given me a period 6 months ago, he said that was not a problem, that could be arranged.
Now it is so that my roommate had apparently put things in his pocket, I knew nothing about it and was not near him at this time. When I went to the checkout, he sprinted after me and was stopped by the shop detective.
At first only he was taken, I was supposed to wait half an hour, so I did, then the shop detective fetched me and said I had trespassed, despite the fact that he allowed me to enter.
He said there was only one charge of trespassing, but now the statement of subpoena to joint shoplifting says that I would have helped him even though I didn't know anything or anything else.
I've already made an appointment with the lawyer, but I can't get the whole thing out of my head. My roommate also says that I could not know anything about his statement and that he did not put the goods in my presence.
You've already turned on a lawyer and your roommate doesn't want to incriminate you. I don't know what else should burden you there.
You have trespassed.
The detective didn't recognize you straight away, otherwise he wouldn't have let you in.
Possibly the ban, that's what worries me, because I'm afraid of the punishment, but as I said, I had specifically asked beforehand and also presented my ID / driver's license, whereupon the shop detective said that would not be a problem, but he said later would still be trespassing (he was also super nice when he got in, but after the theft he was even quite offensive to me, so think that he was generally angry about my roommate)
Did he, I had spoken to him about it and also presented my ID, said I have paid my fine, etc. And he said it would not be a problem
They can summon you for a lot at first, but in the end they have to prove in court that you and your roommate planned a shoplifting. It's not enough that you went to a shop together. Your roommate does not burden you, so they actually have nothing in hand.
Even with trespassing, I see only a small chance if you have really asked for permission before entering the shop and have pointed out the existing house ban. Your roommate can testify that you were allowed to do so.
Then your roommate should confirm the story that you were allowed in. Relax and deny anything to the police.
Told him that I would have been banned from the house without a specified deadline and he said that would not be a problem because I had paid my deadline, I should just say which department I want to go to
Didn't he…
House ban is lifelong.
No, the current letter says 2 years. He hadn't told me that before and as I said I would have said yes I was given one 6 months ago and he said it had expired again and after that no problem
But there's no accusation of trespassing in the summons. Therefore, from my point of view, this is not an issue.
Yes, it is sooo
Then your roommate can probably cheat that too. Otherwise testimony stands against testimony.
