Sold a laptop on Ebay Classifieds. I received money through Paypal (friends and family) and I sent package about 2-3 days later.
Now I have an ad or a summons (as an accused) because I allegedly did not send the laptop.
I kept the receipt for the tracking with me all the time, but recently threw it away, since the sale is now 1 month ago and I thought that everything went well. (My mistake)
My question: what can happen now? Although I can no longer show that I have actually sent the laptop, but just as little can the buyer prove that I did not send it.
Is it a statement against a statement if I do not go to the summons or do I now draw the short straw? What would be best?
Of course, you are in the burden of proof. At least you have to prove that you sent a package.
If that thing is not there after a month, will he have contacted you before?!
Had you looked into the tracking before and seen that it was delivered?
Did you send the tracking link to the buyer? Then there would have to be the email and the tracking be traceable.
You pull the shorter because you can't prove the shipping.
And the prayer wheel: eBay classifieds only for personal pickup!
You have to prove the shipment.
Go to the summons and describe the case. It is worth a try…
But why am I in the burden of proof? Does not he also have to prove that he has not received anything? He can tell stories like that, I do not understand the whole thing.
I had the link back then. But did not send him anything, he did not ask drum. I just did not think.
You sold something and got money, you have to prove that the goods were delivered. Such proof is easy to provide. See my notes. Again: Have you checked the tracking itself and seen if the shipment was delivered? Did he never contact the ad and ask where the goods are?
Yes, it had checked. Everything was fine too. He had not reported before.
But do I have to prove that even if he has sent me via paypal (friends and family)?
How he paid, does not matter. He can prove that he has sent you money. You have to prove that you have sent the goods. That he has not reported before and instead shows you directly is strange, however.
