Let's assume the following scenario:
A parcel carrier is delivering parcels when someone comes around the corner and asks if the parcel is in the hand of the messenger.
The courier answers: "The package is for family. Are you?"
The stranger answers this question in the affirmative, accepts the package and signs it. So he got hold of the package (a notebook) and drives off on his bike.
Is the deliverer liable for the damage?
The courier is of course obliged to deliver the package to the correct recipient. He can assume that he is at the right address.
Basically yes (the company at least… ((…)) …) because it was grossly negligent and contrary to all instructions.
1.) but that doesn't happen in reality.
2.). This delivery from the truck was done once because the parcel carrier accidentally knew me.
3.) since DHL (or others) is liable for lost packages, the customer gets the damage back.
To what extent the DHL or whoever turns to the parcel carrier is another matter.
Then the deliverer is liable… (DHL) … For the damage?
Point 1: unfortunately God's it happens more often than I would like. But it has become less.
If you know the guy it doesn't matter.
