Get a defective laptop via ebay - Paypal case. What are my rights

I bought a laptop through eBay classifieds and paid for it via Paypal W&D.

The laptop arrived damaged, i.e. The case was bent and had breaks / cracks.

The seller was informed and he reported it to the parcel service as the packaging was also somewhat damaged.

When I told him that I had a specialist dealer unscrew the laptop in order to identify further defects, he freaked out and withdrew from the transaction.

They discovered: A very bloated battery, broken screws inside and two broken fans.

This damage definitely did not happen in the mail.

Now it runs through PayPal and it drags on. Have submitted all the details and information but PayPal always wants more information.

Since I have bought the laptop and it is in my possession, is it not my right to have it unscrewed in order to check the defects or not?

Can someone give me solid information about my rights here?

Isn't it my right to check the inside of the laptop?

I think, however, that as soon as you realize that it is defective or does not correspond to what was stated, you should have sent the product straight back straight away.

Unscrewing now proves that you could have tampered with the product so that you could get your money back, so it goes without saying that the seller who sold a defective product now blocks and withdraws because he can now accuse you of that you botched to get your money back.

But I think Paypal knows something like that. I would still try the buyer protection and try not to mention unscrewing the laptop and say that you only wrote that to the seller to lure him out of the reserve or something similar.

But in itself. Sure, you have the right to check whether the item you received corresponds to the manufacturer's information. However, this is usually done by the manufacturer or, in this case, the seller.

Then you have to give this information to PayPal, otherwise they will decide against you.

It can also be that PP wants an expert opinion that you have to pay, the costs of which are not covered by the buyer protection.

It is not only your property, but also your property, with which in principle you can do whatever you want.

But since, as written, an expert opinion will probably be required, you should refrain from tinkering with the thing yourself.

PayPal is out there. They only guarantee that a delivery will take place and that the buyer has not made off with the money or gone bankrupt.

PayPal does not take on any shipping risk, and also no complaints about defects, that has to be clarified under civil law. So you will almost certainly not get any money back from PP, unless the buyer agrees to a return and a refund.

Then why do PP collect 2% when they almost never pay? I agree! Is a clever business model!

As a seller on Ebay classified ads, I would reject PayPal. Then a kind of "guaranteed property" applies if it has not been declared as defective.
