Müller bought a laptop from PC dealer Brusig at a price of 1,300 euro. When Müller has already received the receipt for over 1,300 euro from Brusig, he realizes that he only has 1,000 euro with him. Brusig, who had never had any problems with customers before, gives him the laptop against Müller's oral promise to bring the remaining 300.00 euro to the Brusig shop on the same day. Three weeks have now passed. Müller did not react to two reminders from Brusig. Brusig is now considering whether to hire a lawyer because of the € 300.00 unpaid by Müller.
a) Who is right in this case? Justify
b) Would you advise Brusig, taking into account evidence, to initiate legal proceedings against Brause for the remaining 300.00 euro? Justify
Who should be right? The dealer is entitled to full payment.
But being right and getting right are two different things. If he doesn't have credible witnesses, he probably won't run the risk of a lawsuit.
However, I would send the buyer a reminder, because the costs are limited.
To a: Clearly the breast. You can work out a reason for yourself.
To b: No. You can work out a reason for yourself.
