Defective hard drive - what happens to the data (Media Markt)?

Years ago I was guaranteed to replace a defective hard drive on my laptop (Media Markt), my question is, what will be done with the hard drive, if Media Markt keeps it, will it be disposed of immediately? I would be interested to know if someone had access to the files that were on it?
