Salaries not paid due to no order being placed?

The employer (AG) suddenly quit me during my vacation at the end of December, without officially handing over the order.

So far, the AG has not paid the salaries in December and November (!). After my request, the AG reports that I have not handed over my work properly, e.g. The passwords from Firma-Laptop… Can it be so? First handover and then pay salaries? The reason is not my fault either, but the chaotic operational management. I can't change the passwords on site right now because I have started my new work in another city.

I would simply file a lawsuit with the labor court for the outstanding wages.

Yes, I already sent the first written reminder today.

You have (had) a contract in which a fee was agreed. That has to be paid. Withholding wages afterwards with bad reasons is not only bad style, but also illegal. I would not make out for long - hand over all things like a laptop etc. To the AG (against signature) and then send a reminder with a short deadline for payment (10 - 14 days) by registered mail. If that doesn't help - file a lawsuit with the competent labor court. Everything else is wasted time.

Thanks a lot!
