EBay - When is an item considered defective?

I have a gaming notebook where only the sound does not work. The error has been repaired once by the manufacturer, but has occurred again.

The notebook would still have a (used) market value of about 1000-1200 euro when intact.

If I would now offer the notebook for auction in eBay, would I have to list it as a defect / spare part? Or can I offer it as used with the note that the sound does not work and would need to be repaired.

I'm mainly concerned with the legal aspect, so that no claims for damages can be made.

Is eigl synonymous already a defect, because the article as it was once bought new not all functions are functional.

It would still list as used, as on eBay defect is usually considered complete scrap.

In any case it is better to offer it as "defective" when an important function fails. Although you can describe the error in detail and thus you are formal-juristically "out of the tailor", but a bidder who is too lazy and does not read, may mean, annoyance and more work.

Used is an article that is technically in order and its utility value completely fulfilled. Age and use-related scratches and stains do not change the full functionality.

By your logic, almost every car on the used car market would have to be sold as defective.

In one, the rear windshield wiper does not work, in another the right window regulator or the mirror heater. Here the CD player on the radio does not work anymore and there the 12 V socket in the Kofer room does not work anymore.

No, that's your own fault. Because you are obliged to read the whole offer. If you only skim it over and then buy it, but then realize that it does not work, you just have bad luck. If someone opens a case, the item description will be included in the case. And if the ebay support people read this, the case is directly decided and closed again for the seller who explicitly mentioned the defect.

Right, any that has a defect in its main components… Engine or transmission. Is not bad if the reverse does not work…

But a sound chip is not just a trivial component as a missing label on some keys of the keyboard, which can be exchanged anyway very cheaply (about 25 euro plus installation 10 euro) and within a few minutes even as a whole. A replacement of the sound chip, however, is a very expensive repair that can be economically achieved in my opinion, only by replacing the motherboard… Comparable with an engine failure in the car. In the überigen must not, but the defective sound can be also the indication on a hair crack of the motherboard. So one way or another expensive damage… Still comparable to a beginning bearing damage of an engine (= engine damage)

For the display is similar to the keyboard, and a laptop that can't be started at all often has a broken battery (10 euro on Ebay) or a software error that can be easily corrected. A hardwrefehler, however, would often be a total loss… Like the broken sound chip
