I bought a notebook from Ebay at a retailer. The notebook was B-Ware. When the package arrived, a different notebook was included than I ordered and I told the seller and complained. The package sent back immediately, of course. It also arrived at the dealer and this paid me back my money. 14 days later I received a mail where the seller threatened me with court because I should have sent back a wrong notebook. Now I wonder what happened in these 14 days after receiving the package? Does not the seller have an immediate inspection obligation under the HGB?
