Yes you can do that. The free upgrade from Windows 7/8 to Windows 10 still works. If you have a pre-installed Windows 8 without your own Windows 8 license key, then under no circumstances should you reinstall Windows 10 from scratch, but as an upgrade from Windows 8. Otherwise you will lose the Windows 8 license if you can't restore Windows 8 if necessary. It is best to use the Microsoft Update Assistant and start the upgrade from the desktop. However, this requires about 30GB or more of free space in the Windows partition.
