Thermal pad or not?

I'm just about to change my thermal paste on my laptop, now the question arises, since I have no knowledge of thermal pads yet, whether this is one of the second picture below. I don't think so because it feels really like plastic, but I want to be sure and ask.

A thermal pad should be more like rubber. So if it's hard as plastic, then I don't even think it's a thermal pad.

Where below? Where is the CPU?
