Rückgagebrecht outside the 14 days in case of device defect / defect?

In November of last year, I bought a relatively cheap laptop in a well-known electronics retailer. The area of application should be limited to research and simple office work.

Since I have a lot more to do in addition to the activities planned for the laptop, I only rarely come to the actual use.

For some time, however, the laptop was noticed with a poor performance. Crashes in simple writing in Word documents, eternal loading of programs or Internet searches etc.

I have already sent the laptop 2x for repair. Both times the hard disk was changed, last time additionally a cable. As a whole, however, this was only partially successful.

Since this is the second improvement and I strongly doubt that the story reaches a happy ending, I want to change the purchase contract (ie resign).

My concern is now the day of purchase. Beginning of November.

What is legal? Does the Händle have to agree to my request? Of course, I have all the evidence of rework at hand.

You are entitled to a guarantee - that is to the intended function.

Further claims are likely to go nowhere.

A resignation - in whatever form - I consider utopian.

You probably have no choice but to send the device again and on the

to insist on proper function.

Since it is in your case, however, only a bad buy - well guess - I see no chance.

Thanks for your quick reply.

As you already wrote, I'm entitled to a proper function - I absolutely agree. That may be expected with a purchase price of several hundred euro. It does not open to me only the statement "bad buy".

I expect from a computer that also appropriate activities can be accomplished. Surely I do not speak the high-end games of the AAA class, but office activities in any case. If a computer meets these basic requirements, I do not see the device as a nice paperweight.

Certainly I can send the game to the dealer every 2 weeks to expect a repair, but it does not make sense to me. If I go through the game every two weeks for the next two years, I will eventually charge them the fuel costs.

As a precautionary mention: pure guess (bad buy).

Just wanted to know how you react to it.

As you may call your case now - repair / fix a performance deficit or whatever - I can't judge.

There are probably still a lot of information needed, which unfortunately I can't give you.
