Is it still possible to exchange it at Mediamarkt after 2 months?

A question

is it still possible to exchange a notebook after 2 months? I would like to get another notebook and pay 300-400 euro more to get a better product.

The notebook has already lost a lot of its performance in this short time, so the battery does not last long and it hangs up after a while. The case creaks extremely even if you just take it in your hand… That was an absolute bad buy on my part… I just wanted to buy a good notebook for work, but well

You can claim a guarantee or warranty.

Of course, you can no longer give it back.

If it is a matter of material defects, you can assert material defect liability. However, this only entitles you to demand that the defects be repaired. You do not have a right of return.

This is a complaint, not an exchange.

You have a legal warranty of 2 years. If there's a material defect, a decision is often made in the branch as to whether a repair is worthwhile. The dealer may first offer a repair. Everything will be explained to you in the branch.

From a purely legal point of view, you only have the warranty claim, i.e. The dealer can freely decide whether to repair, convert (i.e. Goods + money back) or exchange (e.g. Accept your exchange proposal). This option is only available to the dealer, not the customer.

However, I see a good chance that the retailer will accept your suggestion if there's also an increase in sales. Repairs are often more expensive for the dealer than reimbursement / crediting of the purchase price.

However, this only entitles you to demand that the defects be repaired.

Supplementary performance! The rework is only one of the two options. The second is to replace it with a new device of the same model.

But it is often a rocky road to enforce your law.

Ru

Yes my mistake. It's still early. If you are so precise

The second is to replace it with a new device of the same model.

Not in a new but in a defect-free, equivalent device.

After 2 months it still looks good when it comes to complaints and liability for material defects. Ie. The chances are good in the first half of the year

I had that on my laptop back then. The battery is always left inside, so it is constantly charged. & At some point the battery was defective due to memory effects

But that was from 2001. Newer batteries should last longer here

So you have to get involved in a repair. Battery exchange if possible. Otherwise it is goodwill if you want to make additional payments

This option is only available to the dealer, not the customer.

Section 439 BGB sees it the other way round.

Ga

No, the customer can basically decide whether to have a repair or a new device 🤷♂️

hu

How did you come up with the crazy idea? The customer is even more entitled to change if repair is not possible or it has already been repaired 3 times due to the same error.

Ga

Is in the law 🤷♂️ So I believe the BGB more than you do. If a repair was attempted 3 times, I can probably withdraw without a deadline
