I bought a laptop worth 3000 euro (end of November 2019). This constantly has errors, so it crashes me more often. Does not even achieve 10% of the performance that he should actually be performing. For 3 days he has not even recognized the hard drive, which means that it is currently not working at all, I can probably fix that, but a lot of effort.
My question is whether I have the right to get a PC from the brand in a similar value because they don't seem to be as vulnerable, or whether I have a right to any replacement or compensation (not the same model because this error appears to be almost the same) always occurs)? I would also like to prevent them from always saying that they would like to repair it themselves first, because it does not work and I do not feel like sitting in the queue for 1 hour before being told to send it back to us.
As the end user, you have the usual warranty period of 2 years. However, after the first 6 months have elapsed, you must be able to prove that the defect already existed at the factory at this or a later point in time.
Such serious defects can in no way be a closure that is not covered by the guarantee.
complain about all the defects in writing (registered letter) and ask for a "correction". You do not have the right from the 3 possibilities of the law (improvement = repair; reduction = partial reimbursement, change = return of the device and reimbursement, whereby you have to take a deduction of the usage time).
It is also important to set a deadline and threaten consequences if the seller does not respond.
if you do this in this way with "a pinch of legal German", then the seller knows that the buyer will not be fobbed off and, if necessary, enforce his rights with all means. So that should work.
Do you mean this one?
I also did benchmarks and can only confirm that it is the best high end gaming PC with such a price.
No, there's clear 439 BGB. Rework or exchange: https://www.gesetze-im-internet.de/...__439.html
You are not entitled to anything else.
@Bitterkraut Yes
I bought the HP Omen laptop from Notebooksbilliger, should I rather contact the portal or the manufacturer, also bought a warranty extension for 170 euro, can it be transferred or claimed?
If he no longer recognizes the hard disk, this could be seen as a hardware error (BIOS is part of the hardware) and the manufacturer or dealer would have to correct the error. This can also be combined with the elimination of performance losses. Therefore I would currently keep my hands off the device and inform the dealer about the malfunction.

You're probably still in the guarantee period anyway. You can use this to contact the dealer.
Hard to imagine that you have not yet installed your own software.
In this respect, I asked the question whether it is due to the software or hardware.
Of course, the company must first give the opportunity to repair the "damage".
